Update: Sharpton: Feds Need To Tackle Police Misconduct

Three New York City police officers were indicted in early December for the alleged sodomy of a 24-year-old tattoo artist, after the man was arrested for allegedly smoking marijuana outside of a Brooklyn subway station.

Richard Kern, 25, a four-year veteran, is charged with the most serious crime of using a baton to violate Michael Mineo in October. Officers Alex Cruz and Andrew Morales were indicted on the charge that they tried to cover up the sodomy.

The Rev. Al Sharpton, of the National Action Network, was the first civil rights leader to appear at Mr. Mineo’s side—even as the police department’s Internal Affairs Division and the media said there was no sodomy.

Medical Marijuana Rules Called A Burden On Police

A spokesman for the Michigan State Police said the department does not want the responsibility of destroying excess medical marijuana, as written in the draft rules being discussed today in Lansing.

Greg Zorotney of the State Police executive division said a better solution would be for users or caregivers to destroy excess supply or for the Michigan Department of Community Health to write rules allowing for the transfer of medical marijuana from a retired user to a new user.

Massachusetts Gone To Pot? Police Won't Ticket Marijuana Users

Police departments across the state of Massachusetts reportedly will not ticket people in possession of marijuana, even if they are caught smoking it.

Officials say a new law that decriminalizes having small amounts of "pot" makes it impossible to enforce penalties because it is poorly written.

"We're just basically not enforcing it right now," said Mark R. Laverdure, chief of police in Clinton, a Central Massachusetts town of about 8,000 residents, told the Boston Globe. "You'll probably have a lot of officers that, unless there's a caller complaining about it, won't even bother with it. They probably handled a lot of it informally before and probably more so now."

Lansing Hearing On Medical Marijuana Restricts Testimony

Michigan Messenger’s Todd Heywood is attending the Medical Marijuana proposed rules hearing this morning in Lansing at the Michigan State Secondary Complex. About 200 people are in attendance.

Approximately forty-five minutes into the hearing, the state employees conducting the hearing directed persons offering testimony about rules not to provide any comments that might duplicate concerns expressed by other attendees; a ten-minute time limit per comment had been established as the meeting began. Palm Springs Council To Vote On Dispensary Law

The Palm Springs City Council is expected to vote on Wednesday on a proposed ordinance that could make the city the first and only jurisdiction in Riverside County to allow medical marijuana dispensaries.

The proposed law, that limits dispensaries to industrial zones, will top the agenda at the council meeting at 6 p.m. Wednesday at City Hall, 3200 E. Tahquitz Canyon Way.

The city now has at least four dispensaries operating illegally, with at least one more waiting on the council action to open.

Medical Marijuana Group Sues County For Not Starting ID Card Program

A medical marijuana advocacy group plans to sue Solano County today for not implementing a state-mandated identification card program that protects medical marijuana patients from arrest and prosecution.

Americans for Safe Access will file the complaint in Solano County Superior Court, ASA's chief counsel Joe Elford said this morning.

Elford said Solano is among about a dozen counties in the state that have not implemented the identification card program despite state legislation adopted in 2003 and upheld on appeal in July 2008 by the California Fourth District Court of Appeal.

Medical Marijuana Rules Open To Debate

LANSING, MI - Michigan officials still are working on the rules to guide the use of marijuana for medical purposes.

The Department of Community Health's first crack at drafting official procedures for the program ran into some opposition at a public hearing Monday.

Medical marijuana advocates say the draft rules put too many restrictions on patients. They oppose a proposal that patients and caregivers be required to keep records of the marijuana grown for use.
